Liberty County, Georgia, driver Akeem Walthour, 20, was charged with liquor possession Saturday evening (September 27) after rear-ending the vehicle of Hinesville Patrolman Michael Troutman at a traffic light. According to Lewis Levine of The Coastal Courier, the police car was only scratched in the crash, but the incident became more serious when Troutman found a plastic bag of marijuana in the road after moving Walthour’s vehicle. After further investigation, 4 grams of marijuana were found in Walthour’s car and his passenger’s pants pocket, a misdemeanor amount in Georgia (leading to possible fines and probation). Five beer bottles and two bottles of gin (one of them open) were also found. According to passenger Chuckie Youmans, 17, the marijuana was his. He was charged with possession of alcohol by a minor, violation of open container law, and possession of marijuana.

Several people have hired me recently who were injured in truck and car accidents that occurred due to the at-fault parties using cell phones while driving. My message to you is this: please avoid using your cell phone while driving or, at least, use a hands-free device. Texting and dialing while navigating the road are especially dangerous activities. Why such a "fuss" about this issue?
Since we have become increasingly dependent on cell phones, the number of people using cell phones while driving has risen drastically over the past few years. According to the Insurance Information Institute, at least two dangers arise from using cell phones (for calls or text messaging) while driving. First of all, dialing requires drivers to take their eyes off the roadways. Second, phone calls cause drivers to focus on their conversations rather than concentrate on driving, which can significantly impair driving ability and reactions, putting the safety of drivers, passengers, and pedestrians at-risk. According to the institute, recent research finds cell phone use while driving the most common cause of automobile accidents. To view pictures of vehicle damage resulting from accidents caused by cell phone use, click here.

In Dawson County, Georgia, last week, September 2, five-year-old Omar Gomez was struck by a car as he tried to cross the street to board a school bus that had stopped to pick him up. Of course, when a school bus stops to pick up children, you're supposed to stop, but the driver of a white jeep did not slow down and struck young Omar, knocking him to the ground. According to his cousin and two sisters, young Omar lay on the ground, but was conscious after the accident and, at first, did not want to go to the hospital in an ambulance. Instead he wanted to go to school because he likes school so much. "Yeah, he likes school, that's why," his cousin said. Gomez was taken by ambulance to Northeast Georgia Medical Center where he was reported in stable condition. This report is according to Kevin Rowson with 11 Alive News.
Ms. DeShan Fishel has just dropped her daughter off at high school and was behind the bus when Omar was hit. "He kept on going and going so I turned around, did a u-turn and took after him," Fishel said. She reportedly followed the jeep while she was on the phone with 911. Local police said that Ms. Fishel was instrumental in helping them capture the hit-and-run driver.
When told not to let the driver get out of her sight during the 911 call, Ms. Fishel replied, "Oh, I'm not going to. I chased him down. I'm not gonna let him go anywhere." Police called Fishel a hero but, modestly, Fishel said, "All I could think about was the little kid getting hit and thinking about this person getting away with it." The suspect who was apprehended and arrested was ninteen-year-old Gary Woosline. Police charged him with failure to stop and failure to report an accident. His bond for release was twelve hundred dollars.

Many victims of car accidents suffer from rotator cuff injuries. What exactly is a rotator cuff? It is actually a group of four muscles and many tendons in the shoulder that cover part of the humerus, enabling the rotation of the arm while holding the shoulder in place. A rotator cuff tear often results from one incident of trauma to the shoulder, despite the assumption by some torn rotator cuffs are only associated with baseball or other sports injuries. In reality, rotator cuff tears occur frequently as a result of car accidents. If you believe that you may have a torn rotator cuff or another type of shoulder injury as a result of a car accident, you should consult a physician as soon as possible. Common symptoms of the injury include pain or weakness when moving or lifting the arm, muscle atrophy around the shoulder, and a crackling sensation when moving the shoulder. In order to determine whether the existence of these symptoms points to a torn rotator cuff (partial or full), an MRI will most likely be done. If your tear is serious, there may be shoulder impingement or disturbance to the shoulder capsule, often causing extreme pain and a limited range of motion. If you have sustained an injury to your shoulder such as a torn rotator cuff, call us at 770-577-3020 for a free consultation with an experienced attorney.

Rapid growth has hit Carroll County towns Villa Rica and Temple over the past several years, and both mayors have emphasized the advantages of the drastic changes in reports to the Times-Georgian. The U.S. Census Bureau announced its population estimates recently, showing a population double in Temple from 2000 to 2007 and a tripling of Villa Rica’s population over the same seven years. Though Carrollton is growing as well, it has only grown at a rate of approximately five percent over the reported time span. In fact, if population growth occurs at the same rate in each town over the same distribution, Villa Rica will be larger than Carrollton in five years. According to Villa Rica Mayor J. Collins, the steady increase has boosted the town’s economy and provided new opportunities for residents. Temple’s mayor holds a similar view for his town.
Collins, who grew up in Villa Rica, now owns his own business in addition to serving as mayor. As a result, he sees the growth as a chance for residents to do the same, and if not interested in owning their own businesses, they are certainly provided with numerous opportunities for employment. Modern conveniences are a welcome change, also, such as grocery stores, restaurants, and shopping areas. Collins also mentions the positive effect the increase in population will have on the town’s politics: a larger town means a greater amount of influence in political decisions. In addition to these benefits, a larger tax base means greater potential for the city and no unreasonable tax increases to residents.
Though Temple Mayor Rick Ford also sees population growth positively, he assures residents that he will work to keep the "small town feel" that many enjoy.

Lakeshore Mall in Gainesville, GA, will host a free seminar this Saturday (July 26) for anyone feeling that his or her aging parents need to give up their car keys– permanently. According to seminar creator and speaker Don Linnartz, a talk with parents when their driving becomes hazardous is essential but sometimes difficult. In an attempt to ease that difficulty while also stressing the importance of being sensitive to the elderly’s feelings, he speaks to many about how, when, and why they should have a "talk" with elderly drivers.
Due to diminished vision, slower reflexes, or even dementia from various diseases, older drivers can endanger themselves and others on the road. Despite their limitations, however, the elderly can be very defensive when addressed about them. Linnartz teaches seminar attendees to be careful in wording, timing, and behavior when talking about the topic, and he recommends using near-accidents or fender-benders as opportunities to mention the issue. Some elderly people may recognize at least a small need for adjustment to driving habits, such as avoiding driving at night or making left turns. If done carefully, a concerned son or daughter can refer to such precautions and suggest adding to them. Car accidents are numerous, and we all need to work together to minimize their occurrence.

June 27, 2008 - Earlier this week, 50-year-old Ricky Hawkins crashed into an electric pole head-on at the intersection of Lee and Oak Streets in Southwest Atlanta. Another vehicle was involved in the accident, as well, but the driver was unharmed, unlike Hawkins. Though Hawkins’ injuries were not life-threatening, he suffered from a fractured jaw, and his front teeth were knocked out in the crash. Ambulance medics were unsure if he was experiencing internal bleeding at the time of transfer to the hospital. Because the victim was transported to the hospital quickly, his injuries will most likely heal without further damage. What if the ambulance had not responded in ample time, however?
Sadly, that question may be answered by victims of car accidents in Atlanta next week. According to Grady EMS officials, the loss of nearly one-third of the budget for the ambulance service that covers the city of Atlanta will likely result in extreme delays for ambulance responses upon crashes. Currently, Grady EMS meets its target response time of 8 minutes or less, but budget cuts will lead to fewer units, leading to a possible 35-minute wait for accident victims. To ensure profitability, ambulances may be diverted from emergency calls to less serious transport services that bring in more revenue (like driving wealthy clients home from the hospital).
By cutting budgets, Fulton County Commissioners risk cutting short the very lives of their Atlanta residents. We hope the risk does not become reality.

June 25, 2008 - In metro Atlanta and Douglas County, skyrocketing gasoline prices are turning commuters to alternative transportation, including vanpools and commuter buses. Both Rideshare and Georgia Regional Transportation Authority (GRTA) have seen great boosts in business as a result of the economic change, with waiting lists for vans that were once below capacity and buses with standing room only. As a result, plans for new routes and transportation centers are in production.
At the beginning of the year, Rideshare had 42 vanpool routes. The current number is 53, with six new routes being coordinated. Also since the beginning of the year, approximately 175 more commuters are using Rideshare daily, increasing the total number of daily riders to an average of 550. While the commuters who have already decided to use Rideshare sign up on waiting lists for certain vanpools, those who are unsure about "mass transit" are expressing their interest: inquiries regarding Rideshare options have doubled in a number of months.
GRTA has experienced a similar phenomenon. The buses transport weekday commuters from Douglasville to various destinations in downtown and midtown Atlanta, and some routes have standing room only. The transportation center parking lot is nearly full each day, and new park and ride lots are in the works. This fall, construction will begin on a lot near the intersection of Stewart Parkway and Douglas Boulevard in Douglasville.

The bridge has been closed since May 31 when a deputy discovered a two-foot hole in one of the traffic lanes. Highway 5 has been one of the routes used as a detour for Post Road traffic.

June 23, 2008 - After suffering extensive injuries in a car accident this past January, collegiate fast-pitch softball player Tiffany Jones found herself confined to a wheelchair. Though her prognosis is good, the eighteen-year-old must undergo physical therapy and treatment for an extended (though unknown) period of time. Combined with her excellent physical condition from sports prior to the accident, her hopeful attitude and positive efforts to help her local community should certainly aid in her recovery. Since returning home from rehabilitation in Atlanta, GA, the athlete has been speaking to various groups about her accident, the importance of wearing seatbelts, how quickly car accidents can occur, and simple ways to contribute to society like adopting a pet.
In the accident, Tiffany was riding as a passenger when she was thrown from the vehicle. The car flipped several times, throwing Tiffany out of the back window and causing her to hit the pavement. The list of her resulting injuries is staggering: a broken neck, separated right shoulder, lacerated liver, broken nose, and, of course, bruises and cuts. The scholarship-winning athlete was told that she would never be able to walk again.
Strong and determined, Tiffany has already shown miraculous progress. Her muscles are working to some extent, and her dad reports that she may be working on standing up in less than one month.

June 23, 2008 - After witnessing a family tragedy that led to their own son’s death, metro Atlanta parents Steve Wise and Brandi Lucas have chosen child safety as their personal mission. Wishing that no one would experience what they had to endure four years ago, they have participated in fundraisers for police departments in their hometown of Covington, GA, and held child safety drives since the accident.
The tragic event occurred when young Garet Wise was visiting family. As another relative backed out of the driveway, Garet’s father, Steve, watched the car accidentally strike his toddler, knowing there was nothing he could do to prevent the accident. Devastated, both parents became determined to prevent future accidents involving children. Currently, the couple is planning another child safety seat drive which will take place at the beginning of this school year.

After spending between $30,000 and $40,000 laying new pavement, replacing steel, rebuilding approaches to the bridge near Dog River, and replacing the deck completely, the BOC may drop the bridge’s load limit from 19 tons to 10 tons. As a result, large trucks would be unable to cross the bridge, but local school buses would still be able to cross (since they weigh under 10 tons). In this case, trucks would use State Highway 5 as an alternative route (as they are doing currently).
The plans for the new bridge will locate it just west of the present bridge, allowing travelers on the two-lane county road (which connects southern Douglas County to Interstate 20) to use the reopened old bridge during the construction of the new one.

June 16, 2008 - There are many guidelines to follow if you want to avoid mistakes in your personal injury or worker’s compensation case, but reporting past injuries to your lawyer is one of the most important actions to keep in mind. Even if you believe some of your injuries are unrelated to those you experienced as a result of your accident, it is in your best interest to be honest with your attorney about them. Upon researching all of your past and current injuries, your lawyer will use his or her experience to distinguish those that are related from those that are not and prepare to argue your case accordingly. You may be tempted to believe that your medical records from another state or years in the past will not be discovered, but the lawyer who is representing the other person will most likely find out information about all your prior injuries and treatments.
Perhaps the quickest and easiest way to damage your claim is to try to hide or not disclose information about your injuries. You will lose credibility and possibly lose your case. For more information on mistakes to avoid if you want to win your auto accident case, please order my free booklet, "Mistakes to Avoid if You Want to Win Your Car Wreck Case," by calling 770-577-3020.

June 11, 2008 - You might be in a rush, but you won’t be in a hurry when having to pay the possible consequences of running a red light. The Department of Transportation’s Federal Highway Administration reported through its "Stop Red Light Running" program that 1.8 million crashes in intersections occur each year. In 1998 alone, drivers who ran red lights caused automobile accidents that led to over 80,000 injuries and almost as many as 1,000 deaths (according to federal government statistics).
Just how serious are these statistics? Considering the fact that over half of all United States drivers admit to running a red light, pedestrians, motorcyclists, and drivers alike have great cause for concern. In terms of the likelihood of serious injury or death, this offense is equal to that of drunk driving. The exchange of time at the price of safety is simply too dangerous. By "stopping on red," you may prevent tragic or even fatal injuries that could otherwise occur. In addition to avoiding this temptation when you approach a red light, it is essential that you watch for other drivers who may choose to run red lights due to frustration, "road rage," or, the most common reason, impatience. To ensure your own and others’ safety, always allow yourself plenty of time to reach your desired destination (accounting for possible traffic delays), and pay careful attention to other drivers at intersections. Thank you for your safe driving!

June 10, 2008 - Until experiencing a bone fracture personally, many may not realize the severity and long-term effects of the injury. The most common and often more painful outcome of auto accidents, truck accidents, and motorcycle accidents, a bone fracture may require much more than just a temporary cast or sling: surgery, physical therapy, extended recovery periods, and even chronic pain and permanent partial disability are among the more serious results. In addition to facing the high cost of medical bills, a person with a fractured bone often loses wages due to necessary time away from work for treatment and recovery. Adding to the degree in which a fracture changes the quality of one’s lifestyle, the injured person almost always experiences a loss of independence and mobility, sometimes for a long period of time.
What exactly is a fractured bone? The injury is a medical condition in which a break in the continuity of the bone has occurred. Though fractures can be caused by other medical conditions that weaken the bones of sufferers, they are often the result of force or stress on the body. You may tell someone that you have a "broken bone" after a receiving a fracture in a high-impact automobile wreck or another type of accident, but the technical term in orthopaedic medicine is "fracture" rather than "break." Whether you’ve fractured an arm, wrist, ankle, leg, shoulder, hip, rib, or another fragile bone area, we at Murphy & Associates are well-qualified to assist you with compassionate legal advice. We have seen many cases in which victims of motor vehicle accidents have suffered from broken ankles, broken arms, and other bones, and they have received compensation for their pain and suffering, lost wages, and medical bills. If you have fractured a bone due to an accident that was not your fault, we will meet with you for a free evaluation of your case. We look forward to helping you.

June 9, 2008 - Hopefully, every new driver is frequently warned about his or her "blind spot" and the dangers of not accounting for it properly. How many drivers, however, account for the differing sizes of their blind spots when they change vehicles? Child fatalities caused by drivers who backed into the "invisible" kids behind them seem to answer this question negatively. According to a nonprofit group devoted to child safety around cars (Kids and Cars), over half of all non-traffic accidents resulting in child fatality between 2001 and 2006 were caused by "backover" incidents. In addition, every week in the United States, a minimum of 50
