What does a personal injury attorney do for you?

Not every personal injury attorney handles your case in the same way. Here is what we do if we accept your case.

1.  Initial interview with the client
2.  Educate client about personal injury claims
3.  Gather documentary evidence including police accident reports, medical records and bills
4.  Analyze the client’s insurance policy to see whether there are any coverages which the client has that may pay all or a portion of the medical bills while the claim is pending.
5.  Interview known witnesses
6.  Collect other evidence, such as photographs of the accident scene
7.  Analyze the legal issues, such as contributory negligence and assumption of the risk
8.  Talk to the client’s physicians or obtain written reports from them to fully understand the client’s condition
9.   Analyze the client’s health insurance policy or welfare benefit plan to ascertain whether any  money they spent to pay your bills must be repaid.
10. Analyze the validity of any liens on the case. Doctors, insurance companies, welfare benefits plans and  employers may assert that they are entitled to all or part of the client’s recovery.
11. Contact the insurance company to put them on notice of the claim, if this has not already been done.
12. Decide with the client whether an attempt will be made to negotiate the case with the  insurance company or whether suit shall be filed.
13. If suit is filed, prepare the client, witnesses and healthcare providers for depositions.
14. Prepare written questions and answers and take the deposition of the defendant and other witnesses.
15. Produce to the defendant all of the pertinent data for the claim, such as medical bills, medical records, and tax returns.
16. Go to court to set a trial date.
17. Prepare for trial and/or settlement before trial.
18. Prepare the client and witnesses for trial.
19. Organize the preparation of demonstrative exhibits for trial.
20. Prepare for mediation and/or arbitration.
21. File briefs and motions with the court to eliminate surprises at trial.
22. Take the case to trial with a jury or judge.
23. Analyze the jury’s verdict to determine if either side has good grounds to appeal the case.
24. Make recommendations to the client as to whether or not to appeal the case.
