Recent news release from the U.S. Department of Transportation announces a federal ban prohibiting commercial vehicle drivers from texting. This action from the U.S. Department of Transportation is part of a larger effort in the fight against distracted driving.

Commercial truck drivers and bus drivers who are caught texting while driving may be subject to criminal penalties of up to $2,750.00 and civil penalties. According to the Federal Motor Carrier Safety Administration, those who are texting while driving have their eyes off the road 4.6 seconds out of every 6 seconds. In other words this is equivalent to a driver going 55 miles an hour for the distance of a football field without looking at the road.

In September 2009 during the Distracted Driving Summit, President Obama signed an Executive Order directing all federal employees to not engage in texting while operating government owned vehicles or equipment. All federal employees were required to comply by December 2009.

On Wednesday, March 17, 2010, warrants were issued to the wrong-way driver that was involved in a fatal auto accident last weekend that killed a U.S. Marine on Interstate 20, according to the Cobb County Police Department. Bruce Joseph Quayle, 71 years of age, has been charged with homicide by vehicle, serious injury by vehicle, DUI, reckless driving and driving on the wrong side of the road. Mr. Quayle who is still receiving medical care at Grady Memorial Hospital has not yet been served with the warrants, according to the police department. The issue of the warrants is still pending on his release from the hospital.

According to the Cobb County Police Department, Ms. Suedmeyer is still present at Atlanta Medical Center which she is in critical but stable condition.

On Saturday, March 13, 2010, a fatal accident occurred on Interstate 20 near Six Flags drive as a result of a wrong-way driver. According to the Cobb County Police Department, Bruce Joseph Quayle, 71 years of age, resident of Villa Rica, Georgia, was traveling eastbound on Interstate 20 in the westbound lanes when he struck Lance Cpl. Gregory M. Suedmeyer, 21 years of age, U.S. Marine head-on. Mr. Suedmeyer’s wife was also in the vehicle, Katelyn Suedmeyer, 19 years of age, was airlifted to Atlanta Medical Center and remains in critical but stable condition.

Mr. Lance Cpl. Gregory M. Suedmeyer was transported to Grady Memorial Hospital and passed away from the injuries sustained in the accident. Mr. Bruce Joseph Quayle remains in stable condition at Grady Memorial Hospital.

The Cobb County Police Department is still investigating this fatal car accident. The Douglas County 911 reported receiving many phone calls about a wrong-way driver on Interstate 20 at the time of this accident. The Cobb County Police Department expects to file charges against Mr. Quayle.

According to the Cobb County Police, two teenagers were struck by a CSX train leaving one deceased. An 8 year old child was attacked by two dogs while she played outside her home Tuesday afternoon. Neighbors quickly responded with one calling 911 while the other tried to fight the dogs off her. Police officers responded and had to forceably remove the dogs from the child with their batons. One of the officers had to fire a shot at one of the dogs which fatally wounded the animal. Animal control was able to locate the other dog involved in the attack and has since euthanized the animal. The two animals roamed the neighborhood and were not contained by leash or fence. The animals owner is facing charges.

The child attacked attends Rock Chapel Elementary School and has undergone two surgeries in two days. The child remains in the hospital at Children’s Healthcare of Atlanta at Egleston.

In the early morning hours of Saturday, February 27, 2010 seven people were traveling in a Ford quad-cab pick up truck when it went over the guardrail on Interstate 75. Snow Fall Likely to Affect Driving Conditions

Late this morning, the National Weather Service issued a winter storm warning for the Metro Atlanta area. Many flights were cancelled coming in and out of Atlanta as the winter storm moved into the state from the west. The weather forecasters predicted one to three inches of snow and it would continue to fall throughout the afternoon into the evening hours.

Many school systems are shut down for the day and the school officials in Cobb, Cherokee, Douglas, Bartow, Forsyth and Paulding counties and the city of Marietta sent students home early.

In Cobb County, the school officials sent the students home two hours early. In Cherokee County, the elementary schools were sending students home at 10:30 a.m. and the middle and highschool students were sent home at 11:30 a.m. In the city of Marietta, the middle and highschool students were sent home between one and two o’clock.

The Weather Service reported heavy snow of about an inch in west Paulding County just after 9:00 a.m.. Schools in Paulding County were closed early, including the elementary school students who were released at 10:30 a.m. The snowfall accumulations reported by the Weather Service, included 3 inches in Cedartown, 3 inches in Toccoa, 2 inches in Helen and Blairsville and 1.7 inches in Ringgold.

According to the spokesman for the Department of Transportation, there has been no ice reported on the state routes or interstates early this morning.

On Sunday, February 28, 2010, a church bus was involved in an accident with a pick up truck, according to the police officers on the scene. The church bus was from Northside United Methodist Church. In August of 2008 Otuwa Otuwa was operating his vehicle while under the influence of alcohol. They implored the judge to sentence Otuwa to a rehabilitation program.

According to the Douglas County Sentinel, Monday night’s collision killed Troy Joseph Johnson of Carrollton. The 37 year old was traveling on Old Newnan Road and crossed the center lane striking Charity Moreland head on. The Georgia State Patrol report that although they are still investigating the scene of the accident, it is unlikely that either vehicle was traveling in excess of 50 miles per hour. GSP also reports that it is unclear if alcohol or drugs played a role in this accident. According to the Georgia State Patrol on Thursday, February 18, 2010, a fatal auto accident involving five victims occurred in South Georgia. Based on information from the Georgia State Patrol, April Cutina White, 37 years of age, resident of Abbeville, Georgia, had a head-on collision with a Georgia State van near Rochelle, Georgia. Ms. White and her three minor children in the vehicle, passed away from injuries sustained in the accident. The passenger in Ms. White’s vehicle also passed away from the accident. On February 21, 2010, a Georgia resident was involved in a hit and run accident in Okaloosa County, Florida. According to the Okaloosa County Sheriff’s Office, Clarence Brasfield, 73 years of age, resident of Georgia, was the victim in the accident.

Vicky Ann Metrejean, resident of Niceville, Florida, has been charged with hitting Mr. Brasfield and leaving the scene of the accident. According to the sheriff’s office, Ms. Metrejean failed to stop after hitting Mr. Brasfield on John Sims Parkway.

Mr. Clarence Brasfield was transported to Sacred Heart Hospital from injuries sustained in the accident. He was listed in critical but stable condition.

Afterwards, a deputy at the Okaloosa County Sheriff’s Office, received a telephone call stating a woman was passed out behind the wheel of an SUV. The SUV was at the gate of Destiny West Subdivision. The damage to the front of the vehicle was consistent with the hit and run accident. A black glove was found in the vehicle that matched the same glove found at the scene of the accident.

According to the Okaloosa County Sheriff’s Office, additional charges are pending against Ms. Metrejean.

At an auto auction in Ellijay, Georgia a car drove into a crowd of people sending many to the hospital, including at least six with serious injuries.

According to the Georgia State Patrol the accelerator in one of the cars to be auctioned apparently stuck as it was being driven into the hall for it to be bid on.

The auction house said it would be closed Wednesday and asked for prayers for the injured.

Local police reported that the vehicle was a Volvo. They are still investigating, but said it was too early to say whether charges would be filed.

On Tuesday, February 16, 2010, a seven year old girl was attached by a pit bull, according to the Cobb County Police Department. The minor child was walking alone in the Valley View mobile home park when she was approached by the pit bull. A gentleman witnessed the attack and came to the minor child’s rescue and struck the dog with a piece of wood. The good Samaritan transported the girl to Wellstar Kennestone Hospital in his own vehicle, after separating the dog and the child.

The attack was reported by an off-duty Marietta City Police Officer, who was working at Wellstar Kennestone Hospital as his second job.

After a medical evaluation at Welllstar Kennestone Hospital the young girl was transported to Children’s Healthcare of Atlanta at Egleston. According to the Cobb County Police Department, the young child suffered a severe injury to her leg. The pit bull which weighed about 115 pounds, was signed over to the animal control and was expected to be euthanized. Charges are expected to be filed against the dog’s owner.

On Friday February 12, 2010 Carroll County Sheriff's Office lost one of their own. Deputy Davy Wayne Crawford 54 of Bowdon was responding to a call when the dispatch office lost communications with him. According to the Georgia State Patrol, they believe the road conditions during the snow storm on Friday may be a contributing factor in this fatal one car accident. Mr Crawford had served with the Carroll County Sheriff's Office for 11 years and with Coweta County prior to that. Sheriff Terry Langley of the Carroll County Sheriff's Office notes the sadness throughout the department as each member is taking it personally. Crawford was a native of Carroll County where he and his family are respected and well known throughout the community.

Twelve Million Dollar Verdict in Salmonella Outbreak

Recently, a salmonella outbreak was traced back to a peanut-based company in Lynchburg, Virginia. There were nearly 120 victims of salmonella from peanuts. A 12 million verdict was reached for the salmonella outbreak and the victims will split the settlement amount. According to the Atlanta Journal Constitution, the legal counsel representing the victims said they could start seeing settlement portions over the next several months.

As recently as one year ago, The Peanut Corporation of America filed for bankruptcy protection, in the event of the salmonella outbreak. The U.S. Food and Drug Administration traced the salmonella outbreak to one of its facilities in Blakey, Georgia. The Centers for Disease Control determined about 714 people became ill sick in 46 states and Canada as a result of the outbreak. The salmonella outbreak may have been the cause of 9 fatalities.

The settlement amount comes from an insurance policy the Peanut Corporation of American had with The Hartford and to be eligible for the settlement, the victims and survivors of the outbreak had to file a claim by October 31, 2009, as part of the company’s bankruptcy proceedings. Additionally, $750,000 from the settlement will be used to pay administrative costs and attorneys’ fees.

On Friday, February 5, 2010, a fatal accident occurred on Interstate 575 at Towne Lake Parkway, according to the Georgia State Patrol. Ms. Mace was the only occupant in her vehicle and she was transported to Atlanta Medical Center with serious injuries as a result of the fatal auto accident.

According to the Forsyth County Sheriff’s Office, alcohol and speeding may have contributed to the accident and charges are pending as the investigation is still ongoing.

On Saturday, January 30, 2010, an auto accident occurred on I-20 eastbound near McDaniel Road, according to the Atlanta Police Department. Angel Woah, 23 years of age, resident of Snellville, Georgia, was pulled over on the side of I-20 East near the Downtown Connector because of a minor accident. Satonya Cleveland, 35 years of age, resident of Lithonia, Georgia, was also pulled over on the side of I-20 east. Both women were struck by an oncoming tow truck outside their parked cars on the interstate.

On Thursday, January 28, 2010, a resident of Decatur, Georgia was involved in a fatal car accident in Athens, Georgia. On Wednesday, January 20, 2010, three teenagers were involved in a pedestrian accident, according to the Dekalb County Police Department. All three teenagers were walking near 4600 block of Central Drive when a seventeen year old lost control of a vehicle and went onto the sidewalk and struck the teenagers.

One of the teens, age fourteen, was transported to Grady Memorial Hospital, and passed away from the injuries sustained in the accident. On Monday, January 25, 2010, a fatal auto accident occurred on I-285, according to the Sandy Springs Police Department. They were traveling southbound in the center lane on Interstate 75 behind another vehicle. Coswell Depeiza, sixty years of age, resident of Gainesville, Florida, was rear-ended by Mr. Lopez. The impact of the accident caused Mr. Lopez’s vehicle to veer to the left and hit the median guardrail. Mr. Lopez and Mr. Velazquez-Molina both were ejected from the vehicle including another passenger that was in Mr. Lopez’s vehicle.

Mr. Velazquez-Molina passed away from the injuries sustained in the car accident. According to the Florida Highway Patrol, Mr. Morales and the other passenger received minor injuries. Mr. Depeiza was not injured and neither was his passenger.

Many people will go out and celebrate with family and friends to bring in the New Year. Local law enforcement wants to remind everyone of the legal drinking age and that drinking and driving do not mix. Patrol will be increased over the holiday time period which will begin on Thursday at 6pm and end at midnight on January 3, 2010. Many holiday accidents are attributed to alcohol and impaired drivers. Unfortunately, those who would not normally take a chance on drinking then driving often do during this celebration season.

According to Georgia Department of Public Safety, estimates there will be as many as 16 fatalities and over two thousand accidents statewide. Cpl Greg Beck of the Floyd County Police Department wants to remind Georgians the legal drinking age is 21 and the legal blood alcohol level can not exceed 0.08 or for a commercial driver the blood alcohol level is not to exceed 0.04. Steve Cantrell, Rome Police DUI Task Force, suggests for those going out to celebrate to have a designated driver who will remain alcohol free for the night.

Georgia State Patrol encourages everyone to call 911 or *477 from a cell phone if you suspect or believe someone is driving while intoxicated.

According to WSB-TV, the girl was at her friend’s houses standing at the front door, when the door opened and the dog jumped on her. The mother ran to help her daughter but was unable to get the dog off her. The mother picked up a brick nearby and hit the dog over the head with it and stabbed the dog many times with a knife her daughter’s friend found. The dog died afterwards.

The girl was transported to Children’s Healthcare of Atlanta at Egleston for injuries from the pit bull attack. The owner of the pit bull was a cousin of the girl’s friend. The owner may be facing criminal charges.

Just before 9 a.m. an unidentified male was crossing the railroad crossing on Sewell Road in Bremen. Yesterday, December 14, 2009, three Sandy Creek High School students were involved in a fatal car accident in Fayetteville, Georgia. According to the police, Angel Anthony was riding in the back seat of the vehicle at the time of the accident and was not wearing a seatbelt. Early this morning, two people were seriously injured in a car accident on the Downtown Connector in Atlanta, Georgia. According to the Atlanta Police Department, the accident occurred when a man was traveling north in the southbound lanes of I-75/I-85. On Friday, December 4, 2009, a three-car accident occurred in New York City involving NBC’s news veteran Tom Brokaw and his wife, Meredith. According to Examiner.com, the accident happened on the Bruckner Expressway in New York City. Mr. and Mrs. Brokaw were traveling in the far left lane when they noticed a spool of cable bouncing along the far right lane. An SUV was traveling in the right lane at a high rate of speed and tried to avoid the spool of cable. Mr. and Mrs. Brokaw received no injuries from this car accident, but the driver of the SUV was thrown from her vehicle and died from the injuries sustained. The driver of the mail truck, was transported to the hospital from serious injuries related to the accident.

In the early morning hours on November 22,2009 a young man in Porterdale Georgia overheard a commotion outside his home. The young man then went out to find a man and woman who’s car was stuck in a ditch. The teen offered to help them and as he approached the vehicle a oncoming driver in a “black compact car” going about 50 miles per hour struck the teen. The teenager suffered a knee laceration requiring a 100 stitches, multiple scrapes and bruises along with bruised ribs. He is able to use crutches but for short distances only and for any further distance requires a wheelchair.

In the early morning hours of Wednesday November 25, 2009, an unknown female pedestrian was fatally struck when crossing I-285 near Riverside Drive in Sandy Springs Georgia. The female, who died at the scene, was struck by an eighteen wheeler as she attempted to cross the eastbound lanes. Authorities are investigating and believe she had exited her vehicle which was found against the median wall close to the accident site. Last week at Myrtle Beach, a woman face charges for snatching a woman’s purses and hitting three people with her vehicle in pursuit of trying to getaway with the purse. According to the Myrtle Beach Police Department, Katherine Michelle Johnson, is charged with one count of purse snatching, three counts of leaving the scene of an accident with injuries and three counts if assault and battery with intent to kill. Ms. Johnson’s bond is set at $25,000.00 with the purse snatching, $100,000.00 for each of the leaving the scene accident charges and the bond was denied on the three assault charges.

A seventy three year old woman, was the victim in the purse snatching incident. The three people who were injured, tried to stop Ms. Johnson and one victim, Brenda Williams was seriously injured. Ms. Williams is still under medical treatment in the hospital from injuries sustained in the hit and run accident. According to Ms. Williams mother, Ms. Williams is not responding to stimuli on her lower part of her body and may be paralyzed from the waist down. The medical personnel at the hospital were supposed to perform spine surgery on her this week.

In the early morning hours of Saturday November 17, 2009 Cherie Nicole Mitchell swerved to miss a deer and ended up going down a forty foot embankment landing against a tree. The ordeal which began around 1:00 in the morning ended at daybreak. Ms. Mitchell was pinned and severely injured in the vehicle. Late Monday, November 16, 2009, a two car accident occurred on Rockmart Highway in Rome, Georgia. According to the Rome Police Department, a Chrysler Cirrus was traveling northbound on Rockmart Highway attempting to turn left into Saddle Mountain neighborhood. The vehicle turned into the path of a Dodge Stratus that was traveling southbound on Rockmart Highway. The vehicles collided and came to a resting place at the entrance of Saddle Trail.

Both drivers of the vehicles were able to get out before the Dodge Stratus caught on fire and spread to the Chrysler Cirrus. Once the police officers arrived on the scene, something exploded in one of the vehicles making the flames twenty feet high. The drivers of both vehicles were transported to Floyd Medical Center for injuries sustained in the accident.

The Rome Police Department are still investigating said accident and the driver of the Chrysler Cirrus would likely be cited for failure to yield.

On Sunday, November 15, 2009, a fatal motorcycle crash occurred in Gordon County, Georgia. According to the Georgia State Patrol Post 43, Jody Hight, twenty one years of age, resident of Adairsville, Georgia, was thrown from his motorcycle while traveling northeast on Highway 225 near Highway 136. Mr. Hight lost control of his motorcycle and ran off the roadway and hit a ditch.

Emergency personnel responded at the scene of the accident and performed cardiac life support on Mr. Hight. He then was transported to Gordon Hospital where he was pronounced dead upon arrival from the severe injuries he received as a result of the accident.

The Georgia State Patrol’s investigation believes that drugs and alcohol were not a factor in this motorcycle accident. Mr. Hight was wearing his helmet at the time of the accident.

Several law enforcement agencies have come together during the Thanksgiving holiday travel period to enforce the seat belt law and child restraint law. According to Colonel Bill Hitchens the Commissioner of the Georgia Department of Public Safety, “Through enforcement and education, more people are using seat belts than ever before and that has translated to more lives being saved”. Colonel Hitchens went on to say, “ Far too many people are still not buckling up or taking the time to properly restrain children.” During a 102 hour Thanksgiving holiday travel period last year Georgia State Patrol had to investigate 10 fatal crashes. Commissioner Hutchins noted that of the 10 fatal accidents 6 of the fatalities were not wearing their seatbelts.

Beginning today, November 16, 2009 through the next two weeks motorist can expect high-visibility of law enforcement who will be targeting those not wearing their seatbelt and those who are not restraining children properly. About a month ago, in Henry County, Georgia, on Interstate 75, a charter bus with several members of the Morehouse College Marching band was involved in a bus accident sending many students to the hospital. Ralph Marshall was an employee of a charter bus company, Superior Transportation in Atlanta, Georgia. Vehicle Overturns In Newnan Causing Injuries

On Wednesday November 11, 2009 at approximately 3:30 p.m. a two car collision occurred on Highway 34 Bypass in Newnan, Georgia. An unidentified female driver was operating a Toyota Sequoia traveling near Lakeshore Parkway and heading toward Turkey Creek Road on Highway 34 Bypass when a van with multiple passengers including a mother and two small children, pulled out of Lakeshore Parkway and clipped the rear quarter panel of the Sequoia. According to Trooper Russell Clark of the Georgia State Patrol, it appears the Sequoia flipped a minimum of three times.

An unidentified female was conscious but did sustain injuries. Once emergency responders removed the unidentified female victim from the wrecked Sequoia she was transported by ambulance to Piedmont Fayette Hospital. Fortunately, the passengers in the van were uninjured and the driver of the van was cited for failure to yield upon entering the roadway.

Early morning on October 25, 2009, a sanitation worker employed at Trash Pro Service was involved in a fatal car accident on Highway 113. According to the Georgia State Patrol, Terry Sisson, twenty five years of age, was on the job making his early-morning rounds when he signaled for the vehicle behind him to stop. As Mr. Sisson was giving a courtesy thank you wave, he stepped across the dividing line on Highway 113, and an ambulance heading northbound struck Mr. Sisson.

The sirens of the ambulance were not operating at the time of the accident because it was in transit to a non-emergency call to pick up a patient in Villa Rica, Georgia. The medical personnel performed treatment on Mr. Sisson’s to try to stabilize him.

Afterwards, Mr. Sisson was then transported to Tanner Medical Center in Villa Rica, Georgia by another ambulance, where he met his family and friends.

The medical personnel at Tanner Medical Center were planning to transfer Mr. Sisson’s to Erlanger Hospital in Chattanooga, Tennessee for medical treatment but before they could Mr. Sisson’s passed away at the hospital.

The West Georgia Ambulance nor the driver of the ambulance will be charged for this fatal accident, as speeding was not a contributing factor.

Law Enforcement Goes After DUI Drivers in Peachtree City, Georgia | Atlanta Accident Attorney

On Friday, October 30, 2009, many law enforcement agencies were targeting impaired drivers in several ways including roadblocks in Peachtree City. A total of forty eight different charges were filed against impaired drivers. As a result, the local law enforcement officers found three people with active warrants, six in possession of marijuana, three with open containers of alcohol, one charged with driving under the influence of drugs and two underage minors with possession of alcohol. Also, one convicted felon with a firearm, 12 license violations and six tag violations.

Police roadblocks were set up at locations where in the past many auto accidents occurred. The roadblocks were at eight different locations including, GA Highway 74, Georgian Park, Highway 74, Westpark Drive, GA Highway 54 and Lake Peachtree.

Early this morning, a single-vehicle fatal accident occurred in North Hall County, Georgia. According to the Georgia State Patrol, Kaela Allison, twenty two years of age, was traveling northbound on U.S. Highway 129 when it veered off the roadway, over a residential driveway and yard, struck a tree and then hit a parked car. Ms. Allison attempted to flee the scene of the accident on foot and the Hall County Sheriff’s tracking dogs tracked her to a church on Nopone Road. Ms. Allison was not traveling alone, a twenty seven year old male passenger, died from the impact of the vehicle crashing into a tree and parked car.

The Georgia State Patrol charged Ms. Allison with driving under the influence, failure to maintain lane, leaving the scene of an accident and first degree vehicular homicide. She was transported to Northeast Georgia Medical Center for injuries sustained in the accident. After the proper medical treatment, she was then taken to Hall County Jail.

Mr. Peyton Marsh, a twenty two year old UGA student was injured when his car left the road and struck a tree. Mr. Marsh was traveling toward Athens when he ran off the side of the road and struck a tree in his sport utility vehicle. According to EMS Director, James Matthews, Marsh was extricated from the wreckage which took approximately ninety minutes then flown to Medical College of Georgia Hospital.

Trooper Patrick Brantley of the State Patrol of Georgia noted that another vehicle had to maneuver their vehicle to avoid a collision. As such, Marsh will be charged with failure to maintain his lane.

As of today, Tuesday November 4, 2009 Mr. Marsh was listed in fair condition and is being treated at Medical College of Georgia Hospital.

Officer Not Injured In Monday Morning Collision

The Georgia State Patrol reported that a Polk County police officer was not injured as a result of a collision that occurred Monday morning about 8:45 a.m..The officer, Joshua Martin, was on routine patrol when another motorist Meril Dennis was making a left turn in her Ford Explorer. Ms. Dennis apparently turned in front of the officer causing the collision. Ms. Dennis and her three year old child in the back seat were apparently injured and taken to the Polk County Medical Center for precautionary measures.

Tuesday afternoon on October 27, 2009, a fatal accident occurred in Henry County, Virginia involving a Georgia resident. According to the Virginia State Police, Virginia Bolton, sixty nine years of age, resident of Austell, Georgia was a passenger in a vehicle. The vehicle Ms. Bolton was traveling in was headed eastbound on U.S. Highway 58. As the vehicle was making a left hand turn at Carver Road a pickup truck was traveling in the opposite direction and hit Ms. Bolton’s vehicle causing them to spin into another vehicle.

Ms. Bolton was transported to Memorial Hospital of Martinsville in Henry County, Virginia from injuries sustained in the car accident. She was later pronounced dead from the impact of the accident.

Virginia Loggins, eighty eight years of age, resident of Stuart, Virginia, was the driver of the vehicle Ms. Bolton was in. Ms. Loggins was transported to the same hospital as Ms. Bolton with injuries. Both were wearing seat belts at the time of the accident.

As a result of this fatal accident, Virginia Loggins was charged with failing to yield the right of way.

Monday evening on October 26, 2009, a single-vehicle accident occurred in Coweta County, Georgia. Tabatha Hausenfluck, thirty four years of age, was traveling westbound when an off-duty ambulance driver was traveling eastbound going towards a curve and saw Ms. Hausenfluck’s vehicle in his lane. Ms. Hausenfluck has charges pending against her for failure to maintain lane, no seat belt and driving under the influence of prescription medicine.

Car-Motorcycle Accident Involving Two Police Officers Injures One, Still Under Investigation | ATL Injury Lawyer

We recently posted a blog about a police officer who sustained injuries in a Clayton County motorcycle accident. According to an update from the Atlanta Journal-Constitution, the crash, which occurred last week, involved two Clayton County police officers and is still under investigation.

The officer we previously wrote about, Officer Thrift, reportedly sustained injuries to his leg and foot and had to be flown to Grady Memorial Hospital last Thursday. According to the police report, the accident occurred when the other officer, identified as Officer Sawyer, attempted a U-turn while driving south on Tara Blvd. at its intersection with Cardinal Rd. As Officer Sawyer was navigating his turn, Officer Thrift's motorcycle crashed into the rear bumper of Sawyer's vehicle.

Although Thrift was ejected from his Honda motorcycle and stated that Sawyer pulled in front of him, it is not known if an at-fault driver has been identified or if any charges have been filed in this incident.

Friday morning on October 23, 2009, in Hart County, Georgia, a school bus and a Chevrolet Cavalier were involved in an auto accident. The driver of the Chevrolet Cavalier was transported to Greenville Hospital System for severe injuries sustained in the accident.

According to the Hart County Schools Transportation Director, Ronald Franklin, no injuries were reported for the children nor the bus driver.

A paralyzed man from Lavonia, Georgia is on his way by wheelchair to the Georgia-Florida football game on October 31, 2009, in Jacksonville, Florida.

His motive in taking this three-hundred and fifty mile trip is not just to see the football game, but to bring attention to the importance of stem cell research and to demonstrate his need for such a procedure that might help him walk one day. Brad Williams says he is determined to walk one day. He is quoted as saying, “I want to do this more for my family than for myself.”

When Mr. Williams was traveling near Thompson, Georgia, Deputy Marc Coy of the McDuffie County Sheriff’s Department aided Mr. Williams by helping to escort him through the county and was quoted as saying, “ He gives people a ray of hope that things can get better watching him do what he is doing and how his life has changed.”

Last Tuesday on October 13, 2009, a fatal vehicle accident occurred on Highway 78 in Stone Mountain, Georgia. According to the Dekalb County police officers on scene, James Miles, fifty-five years of age, was switching lanes when he hit the rear bumper of a van and killed three people. Six others were injured when the van flipped over. The roof of the van had to be cut off by emergency personnel to rescue all nine people inside the vehicle. In result of this fatal car wreck, James Miles was charged with improper lane change and three counts of vehicular homicide in the second degree.

In the early morning hours of October 15, 2009, three lives were claimed in an accident involving multiple cars. Johnny Perlotte, 48, Tony Chapman, 47 and Cadaro Perlotte, 23, and the son of Johnny Perlotte were killed instantly when the crash occurred on U.S. Highway 78. The three fatalities were individuals who were traveling in a Mitsubishi single cab pickup. The two other vehicles involved were a Chevy Cavalier and a tractor-trailer.

The accident which occurred around 6:00 a.m. between Crawford and Lexington Road in Oglethorpe County shut down the four-lane highway for approximately ten hours. According to Sgt. 1st Class Scott Andrews, the cause of the collision is unknown; however, it is confirmed that the tractor-trailer which was carrying empty chicken cages was headed east. The pickup was left pinned between a dirt embankment and the tractor trailer. Deputy Coroner Howard Sanders noted that he had never seen anything in his seventeen years of responding to an accident like this before. He noted there was nothing remaining of the pickup truck.

The Chevy Cavalier was occupied by a forty-four-year-old woman who was transported to Athens Regional Medical Center with a lacerated spleen and punctured lung. The Cavalier she was traveling in was just west of the other two vehicles. The driver of the empty tractor trailer was not injured in the accident.

Investigators from the Georgia State Patrol’s Specialized Collision Reconstruction Team worked to investigate and determine what actually happened. They utilized leaf blowers, propane torches and fans to help dry the road during the persistent drizzle. As of late Thursday afternoon the investigation was still underway.

Flood of 2009

In mid September of 2009, history was made in Douglas County and surrounding areas. More than twenty-one inches of rain poured down in Douglas County, making many residents and businesses susceptible to the flood damage. Flood damage estimates could total up to five million dollars, according to the Douglas County Water and Sewer Authority.

Most of the damage that occurred because of the flood waters may be covered under Douglas County Water and Sewer Authority’s insurance and the Federal Emergency Management Agency (FEMA). The two major wastewater treatment plants were not damaged; however, the pumping stations serving the plants were flooded. The Douglas County Water and Sewer Authority’s insurance will cover up to ten million dollars with a five thousand dollar deductible for buildings outside the 100-year flood plain. Structures built in the flood plain have a five hundred thousand dollars deductible. The flood also damaged the Douglas County Water and Sewer Authority’s storm water system.

A number of Douglas County residents lost their lives as a result of the flood, and many landmark bridges were washed away. Douglas County’s damage may have been worse if the Dog River Reservoir bridge had collapsed during the flooding. Dog River Reservoir is designed to handle only thirty billion gallons of water daily and, at the time of the flood, more than forty billion gallons of water were flowing down Dog River.

In the late night on September 26, 2009, a motorcycle fatality occurred in Panama City Beach, Florida. According to the Atlanta Journal Constitution, William Lassiter, sixty-one years of age and a resident of Powder Springs, Georgia, was traveling westbound on Front Beach Road and attempted to make a left hand turn when his motorcycle collided with a Toyota Camry. According to the police officers on the scene, no injuries were reported from the Toyota Camry, and Mr. Lassiter died of injuries sustained from the fatal accident.

Mr. Lassiter was a former Marine and was employed at Lockheed Martin in Marietta, Georgia, as an engineer.

Late afternoon on September 30, 2009, two people were injured after a two-car crash on GA State Route 20 at the Intersection of GA 100 North. According to the Georgia State Patrol, Shannon Wilson, a resident of Dallas, Georgia, was driving a Honda Civic while traveling westbound on GA State Route 20. Evagelene Philips, fifty years of age, was driving a Ford Explorer while traveling eastbound on GA State Route 20. Ms. Philips attempted to turn left onto to GA 100 North when she turned into the path of Ms. Wilson's vehicle. Ms. Wilson applied the brakes but still collided with Ms. Phillips' vehicle at the intersection. The force of the impact caused both vehicles to spin around.

Ms. Phillips was transported to Floyd Medical Center with her passenger for injuries sustained in the car crash. Ms. Wilson received minor injuries from this auto accident.

The Georgia State Patrol is still investigating this two-car crash, and no charges have been filed yet.

Georgia transportation officials have introduced a new guard rail system that hopefully will be much safer for the driving community along Interstate 75 and Interstate 16 in Bibb County. Up until the present, concrete walls or metal guard rails were used as barriers along Georgia Highways. According to Deputy Sean Defoe of the Bibb County Sheriff’s Office, the new cable guard rail system is designed to absorb the impact of a motor vehicle as opposed to the metal or concrete barriers. The new barriers will bend more and cause less property damage to the vehicle and possibly fewer injuries. The one disadvantage to the new system would mean a cut through every five miles for emergency vehicles as opposed to every two miles but Defoe stated that this is a small price to prevent serious head on accidents. The project is estimated to be finished in October and the 14 mile span of new cable guard rails has a price of $2.2 million.

On Saturday, September 26, 2009, two motorcyclists were traveling eastbound on U.S. Highway 98 when a motorcycle and a Honda Accord attempted to change lanes at the same time. According to the Florida Highway Patrol, Kennadah Kelley, fifty three years of age, resident of Lawrenceville, Georgia, was driving the motorcycle. Ms. Kelley took immediate action when the driver of the Honda Accord put her brakes on. Ms. Kelley lost control of her 2004 Harley Davidson motorcycle, overturned and slid more than three hundred feet. Ms. Kelley was transported to Sacred Heart Hospital for serious injuries in the motorcycle accident. Roger Williams, sixty years of age, resident of Griffin, Georgia, witnessed the motorcycle accident and tried to pull over and help. Mr. Williams was traveling the same lane as Ms. Kelley before her accident. According to Mr. Williams, she had just changed lanes to pass a truck ahead of them. Ms. Williams then applied the brakes on his 2007 Harley Davidson motorcycle and he was also ejected from his bike. Ms. Williams received minor injuries from this motorcycle wreck. The driver of the Honda Accord, Jane Gordon, sixty seven years of age, resident of Mobile, Alabama, was also a witness to this accident. Both motorcyclists were not wearing helmets at the time of the accident.

On Thursday, September 17, 2009, an Augusta, Georgia resident was arrested after attempting to elude and flee police in a chase and then crashing his vehicle into a cattle truck. According to Richmond County Sheriffs Office, Michael Maw, fifty eight years of age, is charged with hit and run, fleeing from police, failure to maintain lane, reckless driving and driving without a license. The police chase began around noon when Mr. Maw smashed into another vehicle and fled the scene of the accident. The police followed Mr. Maw’s vehicle to Old Savannah Road at Gordon Highway where the police officers used stop sticks to puncture Mr. Maw’s tires. His vehicle then crashed into the back of a cattle truck. Mr. Maw was transported to Medical College of Georgia for minor injuries in the auto accident.

Earlier today, September 2, 2009 officers from Lamar County Sheriff’s Office turned on their lights and sirens to pull over a vehicle with no license plate that was making an improper lane change on I-75. Tragic Tractor Trailer Accident on I-20

Shortly before 2:30 a.m. on Monday, August 31, 2009 a fiery crash claimed the life of one man from Augusta and slightly injured another also from Augusta. Mr. Gerry Streetman, 51 years old was the operator of a tractor trailer traveling on I-20. Apparently the tractor trailer rear ended Mr. James Ramsey who was operating a taxi van. Upon contact both vehicles left the road where the tractor trailer ran into trees and burst into flames. It is said to be believed that Mr. Gerry Streetman died of blunt force trauma. Mr. James Ramsey was transported with minor injuries to Medical College of Ga Hospital.

Highway 92 Road Project

Public opinion and input is top priority in finalizing the new plans for the Highway 92 road project. Federal regulations require several studies to be performed including not only the effects on the animals and wild life in the area but the overall impact on the community and people living in that specific location. In the past this has slowed the process down but now public support and input is critical. In order for the project to move forward citizens need to join together and voice their support for the project to advance.
Director of development for the City of Douglasville, Jeff Noles, showed a drawing of what is to come during the state and local meeting that was held on Thursday August 27, 2009. The demonstration increased excitement among those in attendance. One stakeholder noted the significant change for the better this would be for all of Douglasville now and in many years to come.

In Douglasville, Georgia, on Saturday, August 29th, a family was gathering for a birthday party when an SUV lost control and crashed into their home on Berea Road. An accident claimed the lives of Ashley Ingalsbe and her four year old son early Monday morning. (August 24) The accident occurred when Natasha Searcy crossed the centerline, on Skyview Drive in Douglas County, plowed into a Toyota head-on, investigators said.   Natasha Searcy, the driver responsible for causing the fatal accident was drunk according to police.

The Georgia State Patrol has reported that everybody was buckled up and car seats were also in use. An infant in the Toyota was also seriously injured. Searcy was taken to WellStar Cobb Hospital for minor injuries.

The road was closed for much of the early morning rush hour. The Georgia State Patrol indicated that their specialized collision reconstruction team would be doing the reconstruction of the accident scene.

Natasha Searcy, twenty-two years old, has been charged with vehicular homicide in the first and second degrees, driving under the influence, failure to maintain lane and driving without insurance. She was denied bond on Tuesday, August 25. She is currently in the Douglas County Jail under suicide watch.

Six people were hurt and one died on Browns Bridge Road on Tuesday morning, August 18.

According to police, thirty-three year old Jason Greer’s pick-up truck crossed the centerline on Brown’s Bridge Road 0n Tuesday morning where he hit a Ford Escort head on. The Escort was driven by James Daniel Mote. Passengers in Mote’s vehicle included his wife and daughter. The daughter died as a result of the accident.

Seven people were injured in the accident. After Greer’s truck collided with the Escort, it rolled over and hit a 2005 Chrysler Town and Country Van driven by Elaine Daughters of Cumming. The van was also occupied by Daughter’s mother, Ellen Schwaemmle.

Gainesville Police Department, Lt. Brian Kelly said that after hitting the van, the truck continued to roll until it stopped off the roadway after hitting a when it came to rest against a light pole. Debris from the truck struck another vehicle, injuring eighteen year old Jordan Buchannan.

Charges may not be determined until next week due to the complex nature of the investigation due to the number of vehicles and people according to Lt. Kelly.

On Saturday August 1, 2009 many citizens of Douglas County Georgia met with Representative David Scott to discuss the plans for relocating Highway 92. Federal regulations require several studies to be performed including not only the effects on the animals and wild life in the area but the overall impact on the community and people living in that specific location.

Many citizens voiced their concerns at the meeting. Their topics included relocating the families living in the homes that will be affected, emergency vehicles and access to the firestation. Representative Scott assured those in attendance that all issues were warranted and valid and are being thoroughly thought through and investigated. Scott also assured those who’s homes may be affected that compensation for their moves was in order as well. Georgia Department of Transportation project engineer, Neal O’Brien anticipates that the right-of-way acquisitions to be completed by June 2011.

Early Sunday Morning on August 2, 2009, a three-vehicle car crash occurred on U.S. Highway 1, in North Augusta. According to the North Augusta Department of Public Safety, there were two fatalities and three injured victims involved in the car accident.

According to the Aiken County Coroner’s Office, a Cadillac vehicle, Dodge truck and a Chrysler Minivan was involved in the auto accident. The driver of the Cadillac vehicle, Anthony Williams, 58 years of age, resident of Augusta, Georgia, was traveling north in the southbound lanes of U.S. Highway 1 in Augusta, Georgia. Mr. Williams was driving in the wrong direction when his vehicle sideswiped a Dodge truck who was traveling in the southbound lanes of U.S. Highway 1. Mr. Williams then struck a Chrysler Minivan also in the southbound lanes of U.S. Highway 1.

Mr. Anthony Williams and Ms. Erma Harron, 76 years of age, resident of Richmond Hill, Georgia, was a passenger in the Chrysler Minivan, both died at the scene of the accident resulting from multiple injuries sustained from the fatal car crash.

Three other injured victims were transported to Medical College of Georgia by emergency personnel for non life threatening injuries.

The North Augusta Department of Public Safety and the Aiken County Coroner’s Office is still investigating the auto accident.

Late evening on July 20, 2009, a three-car vehicle crash occurred in Rome, Georgia on Calhoun Road. According to Floyd County Police Department, a Honda Minivan, a Pontiac Grand Prix and a Toyota Scion were involved in the auto accident.
