Posted Panel Of Physicians As Defined By Workers’ Compensation In Georgia

Most employers in Georgia are required to maintain Workers’s Compensation Insurance on their employees. This insurance must provide for physicians to treat an injured worker. In Georgia, employers are required to post a “Panel” of physicians which is accessible to all employees. This panel is often printed on a piece of large pink paper measuring approximately 8 ½ x 14 inches. In order for the “Panel” to be valid the law in Georgia requires the following:

1. Contain a minimum of six physicians with their name address and phone number listed.
2. Of the six at least one should be an orthopaedic physician
3. No more than two of the physician groups should be “industrial” clinics

Some companies may be contracted with a medical group called a “Workers’ Compensation Managed Care Organization” also know as “MCO”. Although this is not common, Georgia Law does allow it.

It’s also important to know that even though your employer has the option to send you to a physician for treatment, you have the right to “one free change of physician” whereby you can choose another physician from the panel to take over your medical treatment.

Should the posted panel of physicians not follow the State Board of Workers’ Compensation guidelines the panel may be deemed invalid. If so, you have the right to choose your own physician who is not on the panel of physicians. The insurance company for your employer will be responsible for paying for your treatment with this physician. Often times, the workers’ compensation insurer may fight this decision in court arguing for whatever reason that the panel was valid. Taking adequate pictures and notes of the panel at the job site can be a key element in your winning this issue before an Administrative Law Judge at the State Board of Workers’ Compensation.
