Texting While Driving Accidents in the State of Georgia

There are several distractions to keep Georgia drivers from focusing on the highway. Of course texting and driving in Georgia is illegal but difficult to enforce. In recent studies, distracted drivers are known to cause many accidents. Use of cell phones or other telecommunication devices is an increasing problem on Georgia roadways.

According to the  National Safety Council, 10 percent of daytime drivers use some type of hand-held or a hands-free phone. The benefits of a using a hands-free phone will help the driver keep both hands on the steering wheel while driving but won’t necessarily reduce the level of distraction.

Statistics: Death Due to Distracted Driving

According to the National Highway Traffic Safety Administration, almost 20 percent of all accidents in 2008, involved some type of distraction. Nearly 6,000 people died in distracted driving accidents and more than half a million were injured in 2008.

Distracting Driving Laws in Georgia

On July 1, 2010, Governor Perdue signed two new distracted driving bills into law, Senate Bill 360 and House Bill 23.

Senate Bill 360, prohibits individuals from using wireless telecommunications for writing, sending or receiving text messages while operating a motor vehicle. The fine for the offense is $124.00 and one point on your drivers license.

House Bill 23, prohibits drivers under the age of 18 from using a wireless communication device. The fine for the offense is $150 and one point on your drivers license.

Federal Distracted Driving Law

In January 2010, the U.S. Department of Transportation announced a federal ban prohibiting commercial vehicle drivers from texting in order to reduce distracted driving on the highways. Commercial truck drivers and bus drivers who are caught texting while driving may be subject to criminal penalties of up to $2,750.00 and civil penalties.
