When we go to the doctor’s office, we have to trust physicians to use their years of medical skill and training to diagnose our ailments, prescribe treatments, and make us feel better. The vast majority of the time the doctors and nurses who we trust with our health will diagnose and care for us carefully and correctly.
Every year, however, countless patients are the victims of medical malpractice. These medical mistakes cause patients great pain and suffering and cost them time and money. The road to a full recovery can be rough, and it is made even tougher when doctors and insurance companies will not admit fault.
Simply stated, medical malpractice is the failure of a doctor, nurse, dentist, or other healthcare provider to use the same degree of care that a reasonably prudent medical professional in their position would use. In order to demonstrate this in a court of law, you need an attorney who understands how to help expert witnesses explain complex medical information to a jury.
If you or your loved ones have been injured by the negligence of a doctor or other medical professional, the most important thing that you can do is devote your time and energy to a proper recovery. While you work on making a full recovery from your injuries, let James Murphy work on getting you a full recovery in the courtroom.
The most frequent types of medical malpractice include: cerebral palsy, failure to properly diagnose cancer, failure to provide the appropriate emergency treatment, failure to provide the proper dosage of drugs, failure to refer a patient to a competent specialist or consultant, surgical errors, amputation of the wrong limb, anesthesia errors, failure to prevent infection, shoulder dystocia, leaving a medical instrument inside a surgery site, and the failure to diagnose a medical condition.
It is important to begin your medical malpractice claim soon after your injury. In Georgia, there is a two year statute of limitations that prevents you from filing your claim more than two years from the date that you discover your injury. This statute gives a little bit of leeway for cases in which the injury from the doctor’s negligence is not immediately apparent. However, Georgia also has a five year “statute of ultimate repose” which bars any lawsuit stemming from an act of negligence that occurred more than five years before the date of filing.
